ABOUT US

Nick and Sons Critter Control LLC provides humane wildlife removal, trapping, exclusion, non-structural wildlife repairs, attic restoration services (when applicable), and preventative wildlife solutions throughout Minnesota and Wisconsin. Our goal is to provide honest recommendations, quality workmanship, and long-term wildlife prevention while protecting your home and property.

SERVICES

Services may include, but are not limited to: wildlife inspections; humane wildlife trapping and removal; wildlife exclusion; entry-point sealing; custom flashing installation; roof vent protection; chimney cap installation; soffit repairs; fascia repairs; gable return repairs; bat exclusion; wildlife damage repairs; attic cleanup; animal waste removal; sanitizing and odor treatment; insulation removal; blown-in insulation installation; air sealing; attic restoration; and emergency wildlife services.

INSPECTIONS

Inspections consist of a visual examination of reasonably accessible areas of the property. Inspection findings are based on conditions visible at the time of the inspection. Hidden damage, concealed entry points, inaccessible areas, or conditions that cannot reasonably be observed may not be identified until additional work is performed.

ESTIMATES

All estimates are based on conditions observed during the inspection. If additional damage or wildlife activity is discovered during the project, additional work may be recommended and will require customer approval before it is performed. Unless otherwise stated, estimates are valid for thirty (30) days. Where repair or exclusion work is quoted, the workmanship warranty described on our Service Warranty page applies to that work unless the estimate states otherwise.

WILDLIFE REMOVAL

Wildlife removal methods are selected based on the species involved, property conditions, and applicable state and local laws. While every reasonable effort is made to resolve wildlife issues, no wildlife control service can guarantee that new animals will not enter the property in the future.

REPAIRS & EXCLUSION

Exclusion work and non-structural repairs are designed to reduce opportunities for wildlife entry. Unless specifically covered by our written workmanship warranty, no repair or exclusion service guarantees permanent prevention of future wildlife activity. CUSTOMER RESPONSIBILITIES AND INDEMNIFICATION

Customers agree to: provide safe access to the property; secure pets during scheduled service visits; notify us of any known hazards on the property; remove personal belongings from work areas when requested; and provide accurate contact information.

Customer agrees to indemnify, defend, and hold harmless Nick and Sons Critter Control LLC, its members, officers, and employees from and against any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of or related to: (a) any pre-existing condition of the property not caused by us; (b) customer’s failure to disclose a known hazard; or (c) any third party’s interference with, alteration of, or damage to work we have completed, except to the extent caused by our negligence or willful misconduct.

SCHEDULING & CANCELLATIONS

Appointments may be rescheduled due to severe weather, unsafe working conditions, or circumstances beyond our control. Customers are asked to provide reasonable notice if they need to cancel or reschedule an appointment.

PAYMENT

Payment is due according to the invoice or service agreement unless other arrangements have been made in writing. Invoices not paid in full within fourteen (14) calendar days of the invoice date are subject to a late fee of $50.00 or 5% of the outstanding balance, whichever is greater, in addition to any costs of collection, reasonable attorney fees, and other remedies permitted by law.

A travel charge of $1.00 per mile applies to all services performed, measured from Hastings, Minnesota to the service address. For services performed at a location more than twenty-five (25) miles from Hastings, Minnesota, the travel charge increases to $2.00 per mile for all mileage beyond twenty-five (25) miles. 

LIMITATION OF LIABILITY

Nick and Sons Critter Control LLC is not responsible for: hidden structural defects; existing damage not visible during inspection; wildlife entering through areas not included in the contracted work; damage caused by storms, fallen trees, vandalism, fire, flooding, or other events beyond our control; damage caused by other contractors or alterations made after our work is completed; or new wildlife activity occurring after completion of contracted services. Without limiting the foregoing, and by way of non-exclusive examples, Nick and Sons Critter Control LLC is not responsible for the following: (a) damage to any vehicle, equipment, or personal property left in or near the work area; (b) roofing nails, roofing materials, or other debris that become dislodged during or incidental to services performed on or near the roofline; (c) additional wildlife damage occurring to the property between service visits during an active trapping, removal, or exclusion engagement; (d) damage arising from pre-existing structural conditions, including weakened trusses, deteriorated roof decking, or other hidden structural defects, that are not visible during inspection; (e) domestic pets, livestock, or non-target animals that enter traps set on the property, including between scheduled service visits; (f) incidental damage to lawn, landscaping, or ground cover resulting from the normal use of ladders, equipment, or vehicles in connection with the performance of services; (g) damage to sprinkler systems, invisible pet fences, underground utilities, buried lines, or other subsurface items that were not disclosed to us or not marked by the customer or a utility-marking service prior to the commencement of services; or (h) any work performed outside the agreed scope at the customer’s request after services have begun, or any damage attributable to the customer’s or a third party’s modification, repair, or interference with exclusion materials or repairs installed by us.

To the fullest extent permitted by law, our total liability to you arising out of or relating to services performed, whether based in contract, tort, negligence, or any other theory, will not exceed the total amount you paid us for the specific service giving rise to the claim. In no event will we be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of income, or the cost of remediating mold, odor, or other conditions not directly caused by our workmanship, even if we have been advised of the possibility of such damages.

DISPUTE RESOLUTION

Any dispute arising out of or relating to these Terms & Conditions or the services we provide will first be submitted to good-faith mediation before either party initiates litigation. Any dispute not resolved through mediation shall be brought exclusively in the state court in Dakota County, Minnesota, or, if a federal court, the United States District Court for the District of Minnesota.

GOVERNING LAW

These Terms & Conditions are governed by the laws of the State of Minnesota. Services performed in Wisconsin are also subject to applicable Wisconsin laws and regulations.

SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

CHANGES TO THESE TERMS

Nick and Sons Critter Control LLC may update these Terms & Conditions from time to time. Updated versions will be posted on this website with a revised effective date.
