LEGAL

 1. Scope of Work

• Nick & Sons Critter Control LLC agrees to perform only the services listed on the approved Jobber Quote, Job, Estimate, or Invoice.
• If additional wildlife activity, damage, or recommended services are discovered during the project, the customer will be notified before any additional work is performed.
• Once approved by the customer, additional services will be added to the existing Jobber Job, Quote, or Invoice and become part of the agreed scope of work.

2. Wildlife

• Wild animals are unpredictable.
• While every reasonable effort will be made to remove wildlife, Nick & Sons Critter Control LLC cannot guarantee immediate capture, immediate removal, or the behavior of wild animals.
• Certain wildlife removal projects may require multiple visits depending upon the species involved.

3. Non-Structural Wildlife Repairs

• Nick & Sons Critter Control LLC specializes in non-structural wildlife repairs intended to help reduce future wildlife entry.

         These repairs may include:

• Soffit repairs
• Fascia repairs
• Gable return repairs
• Roof vent protection
• Flashing installation
• Chimney cap installation
• Wood backing
• Entry-point sealing
• Minor exterior repairs related to wildlife activity

Unless specifically stated in writing, our services do not include structural framing, foundation repairs, structural engineering, complete roofing replacement, or other structural construction work.

Recommendations and repairs are based upon visible conditions observed during the inspection.

Hidden damage or concealed conditions discovered during or after work may require additional recommendations or repairs.

4. Roof & Ladder Work

• Many services require technicians to access roofs, ladders, attics, and elevated work areas.
• All work is performed using industry-standard safety practices.
• Customers acknowledge that roof systems may contain fragile materials, hidden deterioration, weather-related damage, or other pre-existing conditions that are outside of our control.

5. Attic Conditions

Attics may contain:

• Animal waste
• Contaminated insulation
• Nesting materials
• Mold
• Electrical hazards
• Hidden structural damage
• Other unsafe conditions

Recommendations are based upon visible conditions at the time of inspection.

Additional issues discovered during work may require revised recommendations.

6. Property Access

• Customers agree to provide safe and reasonable access to all approved work areas.
• If work cannot be completed because access is unavailable or unsafe, additional trip charges may apply.

7. Payment Terms

• Payment is due according to the payment terms listed on the approved Quote or Invoice.
• Unless otherwise agreed in writing, payment is due on the same day the invoice is issued.
• Past-due balances may be subject to late fees, collection costs, interest, and reasonable attorney's fees where permitted by applicable law and disclosed in the customer's agreement or invoice.
• Returned payments may also be subject to additional fees.

8. Deposits

• Certain projects may require deposits before scheduling labor or purchasing materials.
• Deposits become non-refundable once custom materials have been ordered or work has commenced, except where prohibited by applicable law.

9. Warranty

Warranty coverage applies only to services specifically identified as warrantied on the approved Quote or Invoice.

Warranty does not cover:

• Previously undiscovered entry points
• New wildlife activity occurring after service completion
• Customer alterations or modifications
• Damage caused by third parties
• Normal wear and deterioration
• Failure to perform recommended maintenance
• Areas outside the original scope of work

10. Limitation of Liability

• To the fullest extent permitted by applicable law, Nick & Sons Critter Control LLC's liability arising from any claim related to its services shall be limited to the amount paid by the customer for the specific service giving rise to the claim.
• Nothing in these Terms & Conditions limits liability where such limitation is prohibited by law.

11. Customer Responsibilities

Customers agree to:

• Maintain repaired areas
• Notify us promptly of any warranty concerns
• Avoid modifying repaired areas during the warranty period
• Maintain reasonable property conditions
• Provide safe access for scheduled service appointments

12. Photographs & Video Authorization

• Nick & Sons Critter Control LLC may photograph or video record the property before, during, and after services for documentation, warranty records, training, insurance, quality control, and internal business purposes.
• Unless the customer provides written notice requesting otherwise before work begins, the customer also authorizes Nick & Sons Critter Control LLC to use photographs and videos of completed work for marketing, advertising, educational materials, website content, and social media.
• Nick & Sons Critter Control LLC will not intentionally publish the customer's full name, exact street address, or other personally identifying information without additional consent unless required by law.

13. Scheduling

• Appointment times are estimated.
• Weather conditions, emergency wildlife situations, material availability, or other unforeseen circumstances may require schedule adjustments.

14. Appointment Commitment & Cancellation

• Once a customer approves a quote, schedules an appointment, or otherwise provides written authorization to proceed, Nick & Sons Critter Control LLC may reserve labor, schedule technicians, and purchase materials specifically for that project.
• If the customer cancels after providing written approval or commitment, the customer may be responsible for the cost of custom materials, special-order products, travel expenses, labor already performed, and other reasonable costs incurred before cancellation, as disclosed in the approved quote or agreement and to the extent permitted by applicable law.

ACCEPTANCE

By checking the acceptance box on the service request, approving a Jobber Quote, authorizing work by email or text message, signing a proposal, requesting service, or allowing work to begin, the customer acknowledges that they have read, understood, and agree to these Terms & Conditions.
